1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of Home Pro Partners (the "Service"), operated by Home Pro Partners ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service — what we do and don't do

Home Pro Partners is a marketplace that helps homeowners discover and contact local skilled-trade professionals ("Pros"). We provide an introduction and communication platform only.

We are not a party to any agreement, contract, or transaction between a homeowner and a Pro. We do not perform, supervise, guarantee, warrant, or insure any work, and we do not employ Pros. Any hiring decision, scope, price, schedule, and the quality of work are solely between you and the Pro.

3. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Homeowners may contact Pros without an account; some features require registration.

You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

4. Pro listings, credentials & badges

Pros are responsible for the accuracy of their listing, including company details, services, service area, and credentials. A "Verified insured" badge means our staff reviewed a document the Pro submitted; it is not a guarantee of current coverage. A self-reported "Licensed" label is not independently verified.

We do not warrant that any Pro is licensed, insured, bonded, qualified, or available, and badges may lag real-world status. Homeowners should independently verify credentials before hiring.

5. Acceptable use

You agree not to: misuse the Service or interfere with its operation; post false, misleading, defamatory, infringing, or unlawful content; harass or spam other users; scrape or harvest data; attempt to gain unauthorized access; circumvent the trust-ranking or fee model; or use the Service for any unlawful or fraudulent purpose.

We may remove content and suspend or terminate accounts that violate these Terms.

6. User content & license

You retain ownership of content you submit (messages, photos, reviews, listing details). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content as needed to operate and promote the Service. You represent that you have the rights to the content you submit and that it does not infringe others' rights.

7. Fees & paid plans

Homeowners use the Service for free. Pros may use a free plan or purchase optional paid plans/add-ons (e.g., Pro+, Founding Pro, verified-credentials check, payments). We never charge per lead and paid plans never affect trust-based search ranking.

Paid plans are billed through our payment processor (Stripe). Prices, billing cycles, and renewal terms are shown at purchase. Except where required by law, fees are non-refundable. You authorize recurring charges until you cancel.

8. Third-party services

The Service relies on third-party providers including Stripe (payments), SendGrid (email), Microsoft Azure (hosting/storage), and others. Your use of those features may be subject to the third party's terms. Links to third-party sites are provided for convenience and are not endorsements.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any Pro or homeowner will meet your expectations.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY INTERACTION WITH A PRO OR HOMEOWNER. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your violation of these Terms, or your dealings with another user.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access at our discretion, including for violations of these Terms. Sections that by their nature should survive termination (e.g., content license, disclaimers, limitation of liability, indemnification) will survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules. The exact venue, arbitration, and class-action-waiver provisions should be finalized with counsel before launch.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date, and where appropriate we will notify you. Continued use after changes take effect constitutes acceptance.
